| Eine Patientin mit einem durch Parodontitis verursachten zahnlosen Unterkiefer hat Anspruch auf Implantate in Kombination mit Suprakonstruktionen, entschied das Sozialgericht Hannover.
Die Hannoveraner Richter entschieden, dass sie einen Anspruch auf zahnimplantologische Leistungen im Unterkiefer hat. Zahnimplantate im Unterkiefer seien bei der Klägerin sowohl zur kurativen Krankenbehandlung als auch zur Teilhabe am Leben in der Gesellschaft notwendig, stellte das Gericht fest. |

| Damit stellte sich das Gericht gegen ein Urteil des Bundessozialgericht (BSG) vom 13. Juli 2004 (Az.: B 1 KR 37/02 R): Eine allzu restriktive Auslegung der Anspruchsnorm würde dazu führen, dass auch bei einer medizinisch alternativlosen Implantatversorgung die Kosten von Versicherten eigenverantwortlich zu tragen sind, was nicht immer möglich ist und in nicht wenigen Fällen zur Folge hat, dass Versicherte hinsichtlich eines elementaren Grundbedürfnisses unversorgt bleiben.

The court thus opposed a decision of the Federal Social Court (BSG) of 13 July 2004 (Ref.: B 1 KR 37/02 R): An overly restrictive interpretation of the standard would mean that even in the case of implant treatment without medical alternatives, the insured would have to bear the costs on their own, which is not always possible and in quite a few cases would result in the insured remaining unprovided for with regard to a basic need. |
